AeroMechanical Services Ltd. announces filing of motion to dismiss

CALGARY , Dec. 4 /CNW/ - AeroMechanical Services Ltd. ("AMS") (AMA on TSX-V) announced today that it has filed a motion to dismiss the recent patent infringement lawsuit brought against it by Star Navigation Systems Group, Ltd. ("Star") in the U.S. District Court for the Northern District of California.

Star filed its suit in California and AMS is adamant the Star action is frivolous.

In Star's lawsuit, it alleged that AMS is infringing U.S. Patent No. 7,113,852 ("the '852 Patent"). However, AMS states Star has no legal standing to assert infringement of the '852 Patent because Star does not own the patent. Evidence indicates two individuals own the patent and neither of them is party to the Star lawsuit. In addition, in a current Canadian lawsuit, one of Star's co-founders and owners of the patent, Mr. Hilary Vieira , alleges that Star no longer retains any rights to the '852 Patent, further supporting AMS' motion to dismiss.

In August, Star also requested that the United States Patent and Trademark Office ("USPTO") reexamine AMS' U.S. Patent No. 7,203,630. Star failed to comply with the USPTO rules and regulations, and therefore its request was rejected. The USPTO has not yet acted on Star's further request, and will likely not do so until mid-February.

AMS expects the USPTO to reject Star's request for review.

AMS is disappointed that Star has chosen to attempt to compete with AMS via press release, baseless litigation, and U.S. Patent Office procedure - rather than in the marketplace via better products and services.
