Court finds deficiencies in patent infringement lawsuit, requests additional material

CALGARY , Oct. 30 /CNW/ - AeroMechanical Services Ltd. (AMA) announced today that the U.S. District Court for the Northern District of California (the "Court") has requested further briefing from the parties regarding AMA's September 17, 2008 Motion to Dismiss Star Navigation Systems Group's patent infringement complaint against AMA.

In its Order, the Court found that Star has so far failed to show that the Court has any personal jurisdiction over AMA, without which the lawsuit can not proceed. But, before dismissing the suit, the Court has afforded Star an opportunity to conduct very limited jurisdictional discovery, and has ordered Star to file a supplemental opposition by February 27, 2009 explaining why its complaint should not be dismissed. The Court has also afforded AMA the opportunity to file a supplemental reply by March 13, 2009 , and has scheduling the hearing on AMA's Motion to Dismiss on March 27, 2009 .

AMA remains confident that Star's complaint will soon be dismissed.

On September 18, 2008 the U.S. Patent Office confirmed the validity of AMA's U.S. Patent No. 7,203,630, abruptly ending a reexamination proceeding initiated by Star Navigation Systems Group confirming the validity of AMA's patent and the substantial differences between AMA's products and Star's '852 Patent, the subject of the infringement claim against AMA by Star Navigation Systems.
